What is foreclosure?
Foreclosure is the process in which a lender will take back ownership of a property because there has been a lack of payments. The lender has a right to do this because upon taking out a loan for a mortgage, a homeowner states that they will pay down their loan on a monthly basis until it is paid in full. Once payments are missed, the lender will immediately act on their right to take back the property and the homeowner will be required to leave.

Just how damaging are the consequences of having a foreclosure on my credit record?
A foreclosure is, by far, one of the worst marks you can have on your credit history. Future creditors consider mortgage payments to be the most important payments to maintain. So when they discover that a potential borrower has lost his/her house to foreclosure, lending to that potential borrower represents the highest degree of risk to them.

On top of that, a foreclosure will remain on your credit history for up to SEVEN years. Even if you are not interested in purchasing another house, a foreclosure will cause higher interest rates on credit cards, decreased rental options, higher interest rates on auto insurance, and decreased employment options. Sadly, that is something that cannot be ignored and will not just go away!

NOTE:  Did you know, if you do go into foreclosure your lender(s) may have the right to pursue a JUDGMENT against you in addition to completing a foreclosure? This means that once they sell your property, they will come after you for the difference in what they sold it for and what you owe on it. This does surprise many homeowners and it is our goal to show you how we can help our clients avoid such judgments.

What is a short sale?
A short sale is when a second party, such as us, will negotiate directly with your lender to take less for your property than what is actually owed. Because there is more owed on the house than what it's actually worth at fair market value (what other houses in your area and size range are selling for), it becomes un – sellable. The back payments become higher and higher, the value of the house drops lower and lower, and homeowners find themselves in more and more debt. We are not realtors and we do not want to purchase your home as is because there is more owed on it than it's actually worth. However, our goal is to work with the lender to take a discounted price on the property so you as a homeowner can move on.

Why a short sale?
The reason a short sale can so beneficial is because it allows for you to avoid foreclosure and to walk away from house free and clear. Though it is not a guaranteed strategy, it does open the door for you to be more proactive instead of just being reactive to a foreclosure. Without doing a short sale, the labor and time constraints of trying to sell the home can be very stressful and often times unsuccessful. So it is our goal to take some of that stress off of you and allow for you to move on with your life and after all, that is what you want isn't it?

Can I do this by myself?
Naturally, all of us as homeowners are going to want to take matters into our own hands. Unfortunately, in the case of foreclosure, that is limited. As a homeowner you can contact your lender in regards to refinancing or forbearance. However, you cannot do a short sale. Because there are late payments on your mortgage, which causes your owed balance to be higher than what you originally owe, there has to be a second party to step in to work a short sale with your lender.
